中新社北京6月24日电 (记者 张素)在《中华人民共和国反垄断法》修正两周年之际，中国最高人民法院24日发布关于审理垄断民事纠纷案件适用法律若干问题的解释。
这项新的反垄断民事诉讼司法解释共51条，包括程序规定、相关市场界定、垄断协议、滥用市场支配地位、民事责任、附则六个部分。其中，第一部分集中规定程序事项，主要包括垄断民事纠纷案件的界定、起诉方式、案件管辖、合并审理、证据认定、公益诉讼、中止诉讼等。该司法解释于2024年7月1日起施行。
最高人民法院副院长陶凯元在当日举行的新闻发布会上表示，新的反垄断民事诉讼司法解释将在未来相当长时间内，对于指导各级法院公正高效审理垄断民事案件发挥重要作用。
2012年，最高人民法院颁布关于审理因垄断行为引发的民事纠纷案件应用法律若干问题的规定。据统计，2013年至2023年，全国法院共审结垄断民事一审案件977件。最高人民法院知识产权法庭自2019年1月成立至2024年5月底，共受理垄断民事案件178件，审结131件。
当天，最高法在新闻发布会上还发布5起“近期人民法院反垄断典型案例”。最高人民法院知识产权法庭副庭长郃中林介绍说，案例涵盖垄断协议纠纷和滥用市场支配地位纠纷两大垄断纠纷案由，涉及一般横向垄断协议及轴辐垄断协议的认定及效力、有关知识产权行使行为的排除限制竞争效果认定等问题。
郃中林说，这些案例对于准确理解与适用修改后的反垄断法及新的司法解释具有重要参考价值。
在陶凯元看来，从2012年垄断民事案件规定到此次新的司法解释的发展演进，体现出法院对反垄断审判规律的认识和把握迈向新层次和新境界。她说，法院将以此为契机持续加强反垄断司法，开创反垄断审判工作新局面。(完)
